Terms & Conditions.
Clear communication, agreed scope and transparent payment expectations underpin every Fixtur Services project.
Important draft notice: These are website information terms prepared for review. They are not a substitute for a properly prepared and signed Queensland building contract where one is required. The final version should be reviewed by a qualified Australian legal professional before use as binding contractual terms.
1. Quotations and scope of work
All services are subject to inspection or review where appropriate, written scope, availability and acceptance of a quotation. Work outside an accepted scope, including variations, additional materials and call-out charges, must be separately communicated and authorised in accordance with applicable law and any governing contract.
2. Labour and daily invoicing
For a service expressly agreed to be billed daily, Fixtur Services will record and invoice the authorised hours of labour completed at the client’s property at the end of each working day. Itemised invoices will state the hours worked, agreed rate and any other authorised charges.
3. Payment within 24 hours
Where the client has expressly agreed to daily billing and the arrangement is lawful and consistent with the applicable contract, payment for the completed authorised daily labour is required within 24 hours after the itemised invoice is issued and delivered. The applicable invoice specifies the amount properly due and the payment instructions.
For projects subject to mandatory building-contract requirements, the payment stages, progress-claim rights, due dates and other statutory protections under the relevant contract and legislation take precedence over these general website terms.
4. Overdue accounts and late-payment fees
If a properly due invoice remains unpaid after the agreed payment period, Fixtur Services may issue an overdue reminder and contact the client to resolve the outstanding amount.
A late-payment administration fee is not currently specified or automatically charged by this website. If proposed in future, its amount or calculation method must be identified in the accepted service contract before work begins, appropriately justified, lawful and not an unenforceable penalty or unfair contract term. Mandatory consumer protections and regulated building-contract rules always prevail.
5. Customer responsibilities
The client agrees to provide accurate project information, safe access at agreed times and reasonable communication about any site-specific concerns. Relevant access, scheduling and property requirements should be confirmed in the accepted quotation or contract.
6. Changes, delays and cancellation
Changes to the scope, additional work, supply delays, cancellation and rescheduling will be addressed in the individual service agreement. Any charge for cancellation or variations must be clearly disclosed and lawful.
7. Digital concepts and mockups
Digital mockups are visual concepts and not engineering plans, structural advice, regulatory approval, guarantees of material availability or precise colour representations. Deliverables, revisions, permitted uses and any design fees will be specified in the accepted quotation.
8. Consumer guarantees and statutory rights
Nothing in these terms excludes, restricts or modifies rights or guarantees that cannot lawfully be excluded, including rights under the Australian Consumer Law and Queensland legislation governing applicable building work.
9. Call-out fees, site visits and additional charges
Where a site inspection, call-out, travel allowance, materials charge or return visit may incur a fee, this will be explained and separately agreed in the applicable quotation or contract. The website does not establish a standard call-out fee.
10. Questions and disputes
If you have a question about a daily invoice or wish to raise a concern, contact Fixtur Services as soon as possible on 1300 990 238 or [email protected]. Relevant complaint and dispute processes under applicable law remain available.
11. Governing documents
Where a signed service agreement or compliant building contract contains more specific terms or the law requires a different arrangement, that agreement and the mandatory legal requirements take precedence over this general website statement.
